<h2>Why repeat filers get less protection</h2>
<p>Before 2005, the automatic stay applied fully to every bankruptcy filing, regardless of how many times a person had filed before. Some debtors - or, more accurately, some attorneys acting on behalf of debtors - exploited this by filing bankruptcy petitions purely to trigger the stay and delay foreclosure or repossession, then allowing the case to be dismissed, and filing again when the next sale was scheduled.</p>
<p>The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (<a href="https://1328f.com/glossary.html#bapcpa" title="BAPCPA">BAPCPA</a>) addressed this by adding Sections 362(c)(3) and 362(c)(4), which limit the automatic stay for debtors with recently dismissed cases.</p>

<h2>Section 362(c)(3) - The 30-day stay</h2>
<p>If you had <strong>one</strong> bankruptcy case that was pending within the one-year period before your new filing and that case was dismissed, the automatic stay in your new case terminates on the 30th day after filing, unless the court extends it.</p>
<h3>How to extend the stay</h3>
<ol>
<li><strong>File a motion</strong> to extend the stay as early as possible - ideally at the same time as your petition, but no later than 30 days after filing</li>
<li><strong>Request a hearing</strong> within the 30-day period. The court must conclude the hearing within the 30 days (some courts interpret this differently)</li>
<li><strong>Demonstrate good faith.</strong> You must show the new case was filed in good faith with respect to the creditors to be stayed</li>
</ol>

<p><strong>Presumption of bad faith:</strong> There is a rebuttable presumption that the new case was NOT filed in good faith if:</p>
<p>-- The prior case was dismissed for failure to file required documents, amend the petition, attend the <a href="https://341meeting.org" rel="noopener" target="_blank" title="341 Meeting of Creditors - Open Bankruptcy Project">341 meeting</a>, pay fees, or comply with a court order</p>

<p>If <strong>two or more</strong> bankruptcy cases were pending within the one-year period before your new filing and those cases were dismissed, <strong>no automatic stay takes effect at all</strong> when you file the new case.</p>
<p>This is the harshest provision. Creditors can continue all collection activity as if no bankruptcy was filed.</p>

<p>The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 was the most significant overhaul of the Bankruptcy Code in a generation. Among its changes to the automatic stay:</p>
